By booking or participating in a walk with us you are agreeing to these Terms and Conditions.
Walking in the countryside on footpaths involves a range of terrains. As a result of weather conditions, paths may be muddy and difficult to traverse underfoot. Details of the walks such as ascent and challenge will be advertised, but by booking participants acknowledge that they have a level of fitness to manage the walks. Findlater and Sisters have no liability for any incident caused by lack of fitness or experience.
Risk Walking in the countryside is an adventurous activity. Sometimes with a risk of personal discomfort, injury or even death. While we only walk on designated, planned footpaths, it is important to be aware that we may encounter obstacles such as, uneven ground, mud, slippery ground, standing water, stiles and fields of livestock. The countryside is a working environment where farm vehicles can appear at any time from any point. The weather is also a risk. Whilst attention is paid to a range of weather forecasting, weather in the south west can be changeable and may prove challenging. For the above reasons, walkers must listen carefully to, and follow, the instructions given by the walk leader at all times and wear appropriate clothing and footwear.
Health and Medical You are required to advise Findlater and Sisters before the walk of any condition, medical or otherwise, that might affect your or other people’s enjoyment of the trip, including but not limited to conditions such as asthma, diabetes, heart conditions and allergies. Walkers are responsible for their own health. Findlater and Sisters Walk leaders are qualified Outdoor First Aiders. In the event of a medical emergency arising, you consent to the administration of First Aid measures as may be determined necessary by the group leader or any other person present with current First Aid training. You further consent to any medical treatment being administered by the Emergency Services if they deem it necessary You understand and accept that your health always remains your responsibility.
Responsibility Findlater and Sisters accepts no responsibility for your personal accidents, injury or death. Findlater and Sisters accepts no responsibility for any loss or damage to your personal effects or for your indirect financial loss. You agree to waive any claim that you may have now or in the future against Findlater and Sisters or our walk leader for any injury or any other losses which may arise because of your participation in a Findlater and Sisters walk, except if such liability cannot be excluded by law.
Complaints Findlater and Sisters is committed to making your walk with us as enjoyable and as safe as possible. If for any reason you are not satisfied with something then please bring this to attention of your walk leader as soon as possible. The walk leader will attempt to resolve your concern as far as reasonably possible or to your satisfaction bearing in mind the conditions and the needs of the other members of the group. If resolution is not immediately possible or to your satisfaction then please record your complaint and email it to findlaterandsisters@gmail.com within four weeks of your walk. Your complaint should outline in reasonable detail your concern or dissatisfaction, what has been attempted to resolve them and what your preferred resolution would be. Findlater and Sisters will consider your complaint and update you on progress to conclusion.
Findlater and Sisters Cancellation A walk may be cancelled by us at any time prior to the date of the walk due to a number of circumstances including but not limited to illness of the walk leader, Government advice/ law or adverse weather conditions. The decision to cancel a walk is at the sole discretion of the walk leader. In the event of cancellation by the walk leader, Findlater and Sisters liability is limited to the cost of your chosen walk.
Changes during the walk The preplanned route may be subject to change during the walk due to adverse weather conditions, physical changes to the route (eg fallen trees, presence of livestock, flooding etc) pace of the group, fitness and ability levels, accidents or injuries and so on. In extreme circumstances, the walk may be terminated. Once the walk has commenced any changes to the preplanned walk are deemed to be part of the walk. The decision to change or terminate the walk is at the sole discretion of the walk leader.
Non-Participation The walk leader reserves the right to refuse to include any walker who they consider will be unable to complete the planned activity; is wearing unsuitable clothing or footwear, ignores direct safety instructions from the walk leader, or whose language and or behaviour, in the responsible opinion of the walk leader, falls below an acceptable standard or who puts others within the group at risk. Additionally, if a walker chooses to leave the organised group at any time during the walk and makes it clear and obvious that they are leaving the organised group, then Findlater and Sisters and the walk leader cease to have any responsibility or liability for that walker with immediate effect.
Age All walkers must be over 18 years of age.
Dogs Dogs are allowed and must be kept on a lead at all times.
Accommodation, Food and Travel Findlater and Sisters only provides walking activities. Walkers must provide their own travel and accommodation (if necessary). We strongly recommend that you have adequate insurance in case of cancellation.
Photography Photography and videos are taken on all Findlater and Sisters walks. If you do not consent to your photograph being used in our publicity and social media, please inform your walk leader at the start of the walk.
